1. Acceptance of Terms

By accessing or using any product or service offered by BluByte Innovations ("Company," "we," "us," or "our"), including but not limited to Take3, Tracck, EventFlow, PEClass, CampConnect, and PinTrac, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. FERPA Compliance

BluByte Innovations recognizes its obligations under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, and its implementing regulations at 34 C.F.R. Part 99. Where our services are used by or on behalf of educational agencies or institutions, we operate as a "school official" with a "legitimate educational interest" as defined under FERPA, or as a service provider acting under the direction of such institutions.

• We do not disclose education records or personally identifiable information (PII) from education records to third parties without prior written consent from the parent or eligible student, except as permitted by FERPA.
• We use student education records solely for the purpose of providing the contracted educational service and for no other commercial purpose.
• We maintain reasonable administrative, technical, and physical safeguards to protect education records from unauthorized access, disclosure, or destruction.
• We will promptly notify partnering educational institutions of any confirmed breach of education records in accordance with applicable law.
• Upon termination of services, we will return or securely delete education records as directed by the institution.

3. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the services in any way that violates applicable federal, state, or local laws or regulations.
• Transmit unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any portion or feature of the services.
• Collect or harvest any personally identifiable information from the services without authorization.

4. Accounts and Registration

When you create an account with us, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

All content, features, and functionality of our services — including but not limited to text, graphics, logos, software, and data compilations — are the exclusive property of BluByte Innovations and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, BluByte Innovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the services after any changes constitutes your acceptance of the new Terms.
